What does a Family Will (Husband and Wife with Children) provide?
A Will is prepared for each spouse in similar terms. The Wills provide as follows:-
On the death of the first spouse everything will pass to the surviving spouse who will be the sole executor/trix (i.e. in charge of dealing with matters at that stage). On the death of the surviving spouse everything will pass down to the children equally. If the children are still infants two executors will be appointed to administer the estate and look after the assets for the children until they come of age. We can also include the appointment of guardians and you funeral wishes.

For whom are they suitable?
- Married couples living in England and Wales wishing to provide for each other and ultimately their children.
For whom might they not be suitable?
- Couples who do not reside in England and Wales;
- Couples who have been previously married or who have children from previous relationships;
- Couples with foreign assets or having interests in family businesses or partnerships;
- Couples with children who have special needs.
What is included in the Fixed Fee?
You will be required to complete a short questionnaire to enable us to draft the Will.
The fixed fee includes:
- Preparing the draft Wills;
- explaining the effect of the Wills;
- making any minor amendments;
- providing the final copies for signature;
- ensuring the Wills are properly signed;
- retaining the originals (if you wish) in safe custody for you in our purpose built strong room and providing you with a photocopy of each document.
The fixed fee is not appropriate if your circumstances are not straightforward or if you require advice or guidance to cater for specific circumstances. Why pay a Fixed Fee?
By paying a fixed fee at the start of your case you have certainty about the costs involved. The alternative is to pay an hourly rate (£225 Partner rate / £185 Legal Executive rate / £55 Support Staff rate) plus VAT for the time your solicitor spends on your case.
