What is a Residential Possession Claim?

Powells can pursue a residential possession claim founded upon rent arrears due under an Assured or Assured Shorthold tenancy agreement relating to property situated anywhere within England and Wales.

What is included in the Fixed Fee?

The fixed fee assumes that you have already served a valid notice seeking possession in respect of the tenancy (under Section 8 of the Housing Act 1988). If you have not served the notice and require our help to do so we will be pleased to discuss with you our fees for preparation and if you require us to make the necessary arrangements, service of an appropriate notice.

The fixed fee also assumes that your tenant will not defend the proceedings and that therefore the matters will be disposed of at the first court hearing. In the (usually unlikely) event that your tenant raises a defence to the claim our fixed fee will include all work up to and including the first hearing but thereafter our fees are payable at an hourly rate.

The fixed fee includes:

  • Seeing you once in consultation, if requested;
  • checking the validity of your Notice Seeking Possession;
  • drafting the claim form and particulars of claim;
  • preparing all necessary evidence in support of the claim ;
  • issuing the proceedings and keeping you advised of their progress;
  • either attending court on your behalf or (if the case is in any court other than Weston super Mare) arranging for you to be represented at the possession hearing (regardless of the amount of time we may have to wait at court before your case is heard).

Why pay a Fixed Fee?

By paying a fixed fee at the start of your case you have certainty about the costs involved. The alternative is to pay an hourly rate (£220 plus VAT) for the time your solicitor spends on your case.
