Alternative dispute resolution (ADR) describes an umbrella of various dispute resolution techniques which focus on enabling the parties to achieve a settlement without the need for expensive litigation.
Mediation is the most common form of ADR and involves a mutual mediator being appointed who will actively assist the parties to try to reach a negotiating settlement of their dispute although the parties themselves remain in control of the decision to settle and terms of the resolution. Mediation might take place whilst court proceedings are ongoing or before proceedings are issued by a party. The mediator cannot advise a party as to their legal position and unless the issues involved are straightforward a party should seek legal advice before entering into mediation to ascertain their legal rights and remedies and they may also wish to consider instructing a solicitor to attend the mediation.
